PROOFSTACK PRIVACY POLICY

We collect what ProofStack needs. Not what it doesn't.

This Privacy Policy explains how personal information is collected, used, processed, disclosed, and protected in connection with the ProofStack desktop application, websites, accounts, subscriptions, remote features, and related services collectively referred to as the "Services."

ProofStack is the name under which the software and Services are offered.

Nothing in this Privacy Policy represents that ProofStack is currently an LLC, corporation, partnership, or other separately registered legal entity.

References to "ProofStack," "we," "us," and "our" refer to ProofStack and the person or persons operating the ProofStack Services.

By using ProofStack, you acknowledge the practices described in this Privacy Policy.

This Privacy Policy should be read together with the ProofStack Terms of Service and End User License Agreement ("EULA").

WINDOWS BUILD AND SMARTSCREEN NOTICE

The ProofStack Windows installer may not yet be digitally signed or recognized by Microsoft Windows. Windows Defender SmartScreen may therefore display “Windows protected your PC,” identify the publisher as unknown, or require you to select “More info” and “Run anyway.” This is a Windows publisher-trust warning and, by itself, does not mean that the installer is a virus.

ProofStack is not designed or intended to contain viruses, malware, or other malicious code. Download ProofStack only from official ProofStack sources and use your own antivirus and security tools. ProofStack does not warrant that every download, mirror, update, or third-party copy is free from malware.

To the maximum extent permitted by applicable law, ProofStack is not responsible for damage to your computer, files, accounts, networks, or systems arising from downloading, installing, bypassing, or running the Windows build, including actions taken after a SmartScreen warning. See the Terms of Service and EULA for additional disclaimers and limitations.

1. OUR PRIVACY APPROACH

ProofStack is designed to minimize unnecessary collection of personal information.

We do not want your source code, terminal activity, prompts, repositories, or development work for advertising purposes.

We do not sell your personal information.

We do not sell your source code.

We do not sell your prompts.

We do not sell your terminal activity.

We do not sell your repository information.

We do not use your User Content to build advertising profiles.

We do not use your User Content to train ProofStack-owned general-purpose artificial-intelligence models.

However, certain information must be processed for ProofStack to provide accounts, subscriptions, security, remote functionality, customer support, and other requested features.

The exact information processed depends upon which ProofStack features you use.

2. INFORMATION YOU PROVIDE DIRECTLY

Depending upon how you use ProofStack, you may provide information including:

• email address;
• account information;
• login information;
• subscription information;
• information submitted during checkout;
• customer-support communications;
• feedback;
• bug reports;
• diagnostic information you choose to submit;
• privacy requests;
• other information you voluntarily provide.

We use this information only for legitimate purposes related to operating, supporting, securing, improving, and providing ProofStack.

3. ACCOUNT INFORMATION

ProofStack may require an account for certain Services.

When you create or use a ProofStack account, information processed may include:

• your email address;
• a unique account or user identifier;
• authentication information;
• session information;
• login status;
• account creation date;
• subscription status;
• security-related account information.

Authentication may be provided using independent infrastructure or authentication service providers.

ProofStack may receive identifiers and authentication information necessary to determine that you are properly signed in.

Passwords may be processed by our authentication provider rather than being directly stored by ProofStack in readable form.

We do not intentionally store your password in plain text.

4. PAYMENT AND SUBSCRIPTION INFORMATION

If you purchase ProofStack, payments may be processed by an independent payment processor.

Depending upon the payment processor, ProofStack may receive limited billing information such as:

• your email address;
• customer identifier;
• transaction identifier;
• subscription plan;
• subscription status;
• payment status;
• purchase date;
• renewal date;
• cancellation status;
• billing country or region;
• limited payment-method information such as card type, brand, or last four digits where provided by the payment processor.

ProofStack does not need your complete payment-card number to operate the subscription service and does not intentionally store complete credit- or debit-card numbers on ProofStack systems.

Your payment processor independently processes payment information under its own privacy policy and terms.

ProofStack's standard subscription options may include:

Monthly: 20 USD per month, billed monthly after the 7-day free trial when that offer is shown at checkout.

Annual: 180 USD per year, billed annually in advance, equivalent to $15 USD per month.

ProofStack may offer discounts, coupons, promotional pricing, introductory pricing, or other special offers from time to time.

Payment information may be used to:

• process purchases;
• maintain subscriptions;
• identify active subscriptions;
• process cancellations;
• address payment failures;
• prevent fraud;
• provide customer support;
• maintain financial and transaction records;
• comply with legal and tax obligations.

5. SOURCE CODE, FILES, AND PROJECT DATA

ProofStack is designed to work with source code, files, repositories, development environments, and software-development tools.

Much of this information may remain on your own device.

Depending upon the feature being used, ProofStack may locally process information such as:

• repository contents;
• source-code files;
• file paths;
• project names;
• Git information;
• terminal information;
• command history;
• development state;
• agent activity;
• workspace information.

Local processing does not necessarily mean this information is sent to ProofStack.

When a feature operates entirely on your computer, ProofStack's operator does not receive the information merely because the ProofStack application processes it locally.

6. AI PROVIDERS AND CODING AGENTS

ProofStack may allow you to use coding agents, command-line tools, AI services, and AI providers that you independently choose to connect or use.

When you instruct an agent to process:

• source code;
• prompts;
• files;
• repository information;
• terminal output;
• project information;

the applicable AI or service provider may receive that information.

That transmission is governed by your relationship with the applicable provider and the provider's own:

• privacy policy;
• terms;
• account settings;
• data-retention practices;
• model-training policies.

ProofStack does not control how an independent AI provider handles information sent directly to that provider through your account or credentials.

You are responsible for reviewing the privacy practices of the AI providers and development tools you choose to use.

7. PROOFSTACK DOES NOT CLAIM OWNERSHIP OF YOUR CODE

ProofStack does not acquire ownership of your source code, repositories, files, or projects merely because you use the Services.

Your ownership rights are addressed further in the ProofStack Terms of Service and EULA.

8. WE DO NOT USE YOUR CODE TO TRAIN GENERAL-PURPOSE AI MODELS

ProofStack does not use your source code, repositories, terminal activity, prompts, agent conversations, or other User Content to train ProofStack-owned general-purpose AI models.

This statement concerns ProofStack's own use of your information.

Independent AI providers you choose to use may have different policies regarding model training or data retention.

You should review those providers' settings and policies separately.

9. REMOTE ACCESS AND PAIRED DEVICES

ProofStack may provide remote functionality allowing an authorized device to interact with or monitor a ProofStack desktop session.

For example, a desktop computer may establish a secure outbound connection to ProofStack-related infrastructure so that an authorized paired device can receive permitted information or issue permitted instructions.

If you choose to use remote functionality, information transmitted through the remote connection may include:

• device identifiers;
• pairing information;
• session identifiers;
• authentication information;
• agent status;
• agent responses;
• terminal output;
• command information;
• file activity;
• file names or paths;
• editing activity;
• tool activity;
• approval requests;
• development events;
• Git information;
• other information required to provide the remote feature you request.

This information may temporarily pass through ProofStack-operated or ProofStack-selected infrastructure to deliver it between your authorized devices.

Using remote features therefore differs from using entirely local ProofStack functionality.

10. TEMPORARY REMOTE SESSION PROCESSING

ProofStack may temporarily buffer or process limited recent remote-session events when reasonably necessary to provide functionality such as:

• message delivery;
• synchronization;
• reconnecting a paired device;
• maintaining session continuity;
• preventing duplicate events;
• security;
• troubleshooting.

ProofStack's remote infrastructure is not intended to operate as permanent cloud storage for your development projects.

Temporary technical processing may still occur even though ProofStack does not intend to permanently retain your project content.

Retention periods and technical architecture may change as ProofStack develops, but ProofStack intends to minimize remote retention consistent with providing reliable Services.

11. DEVICE AND CONNECTION INFORMATION

When you connect to online ProofStack Services, certain technical information may be automatically processed.

This may include:

• IP address;
• device type;
• operating system;
• application version;
• browser type;
• timestamps;
• session identifiers;
• connection status;
• general diagnostic information;
• security-related information.

This information may be used for:

• authentication;
• security;
• fraud prevention;
• reliable service delivery;
• debugging;
• compatibility;
• preventing abuse;
• understanding service failures.

ProofStack does not use this information to build advertising profiles.

12. TERMINAL AND AGENT ACTIVITY

ProofStack may process development activity needed to provide its functionality.

Depending upon the feature, this may include information about:

• commands being executed;
• terminal sessions;
• agent tasks;
• files being read;
• files being created;
• files being edited;
• files being deleted;
• files being renamed;
• repository activity;
• tests being executed;
• tool calls;
• agent status;
• timestamps;
• Git activity;
• development events.

Some of this information may remain entirely on your device.

If you enable remote functionality or another cloud-connected feature, relevant activity may be transmitted through ProofStack infrastructure as necessary to provide that feature.

ProofStack does not use this information for targeted advertising.

13. LOCAL STORAGE

ProofStack may store application information locally on your device.

This may include:

• application settings;
• project information;
• session state;
• workspace information;
• local activity records;
• authentication/session information;
• configuration;
• user preferences.

Information stored only on your computer generally remains under your control unless you use a feature that transmits it elsewhere.

Deleting ProofStack may not automatically delete every file or configuration created outside ProofStack's application-storage area.

14. PROVIDER CONNECTIONS

ProofStack may allow you to connect accounts belonging to independent services.

Depending upon the provider and connection method, this may involve:

• authorization tokens;
• OAuth information;
• provider account identifiers;
• authorization state;
• connection status;
• session identifiers.

ProofStack uses such information only as reasonably necessary to establish and maintain the connection you requested.

Provider access may be revoked through ProofStack where supported or directly through the applicable provider.

You should revoke provider access if you no longer want ProofStack or a connected tool to access that provider.

15. CREDENTIALS AND SECRETS

Development environments may contain sensitive credentials such as:

• API keys;
• access tokens;
• SSH keys;
• cloud credentials;
• signing credentials;
• repository credentials;
• environment variables;
• secrets.

ProofStack is not designed to collect such information for marketing or profiling.

However, depending upon commands you execute, tools you authorize, files you open, terminal output generated, and remote features you enable, credentials or secrets could potentially appear in information processed by the Services.

You are responsible for protecting credentials and using appropriate access controls.

We strongly recommend using least-privilege permissions and avoiding unnecessary exposure of secrets.

16. OPTIONAL UPDATE EMAILS

ProofStack may provide an optional way to receive product-update notifications.

If you voluntarily submit an email address specifically for update notifications, that email may be used to notify you about:

• new ProofStack releases;
• important software updates;
• major service changes.

We do not intend to convert an update-only subscription into unrelated marketing without appropriate notice or consent.

You may unsubscribe using an unsubscribe mechanism contained in applicable emails or by contacting:

An update-list email may be stored by a service provider used to deliver those communications.

17. SERVICE AND TRANSACTIONAL EMAILS

If you have a ProofStack account or paid subscription, we may send communications necessary to operate the Services.

These may include:

• account verification;
• password or authentication messages;
• security alerts;
• receipts;
• billing notices;
• subscription notices;
• renewal notices where applicable;
• cancellation confirmations;
• material Terms or Privacy Policy notices;
• important service announcements.

Transactional messages are different from optional marketing communications and may be necessary for your account or subscription.

18. WEBSITE ANALYTICS

The ProofStack website may use Google Analytics 4 ("GA4") to collect usage statistics if you affirmatively allow statistics through the website's consent interface.

Analytics information may include data such as:

• pages visited;
• approximate visit duration;
• browser type;
• general device type;
• interaction information;
• approximate geographic information derived from network information;
• website referral information.

Analytics are used to understand how the ProofStack website is used and to improve the site.

ProofStack does not intend to use Google Analytics for targeted advertising.

Where the website provides a statistics-consent choice, analytics should not be intentionally activated until the required consent has been provided.

19. ANALYTICS CONSENT

Where the ProofStack website presents choices such as:

Allow Statistics

or

Essential Only

choosing Allow Statistics permits optional analytics described in this Privacy Policy.

Choosing Essential Only means optional analytics should remain disabled.

Where analytics consent is legally required, simply ignoring the consent request will not be treated as affirmative consent.

Users may withdraw analytics consent using the consent controls made available by the website or by removing the applicable consent information from their browser.

20. COOKIES AND LOCAL BROWSER STORAGE

The ProofStack website may use cookies or browser storage that are reasonably necessary for functions including:

• remembering privacy choices;
• security;
• authentication;
• account sessions;
• fraud prevention;
• checkout;
• subscription functionality.

The site may also maintain a consent preference such as:

to remember the privacy choice made through the consent banner.

Where used, optional analytics cookies are activated only in accordance with the user's analytics choice and applicable law.

Because ProofStack now includes account and subscription functionality, this Privacy Policy does not promise that ps-consent will always be the only cookie or browser-storage item used by ProofStack.

Essential account, authentication, security, or payment functionality may require additional technical storage.

21. INFORMATION WE DO NOT INTENTIONALLY COLLECT

ProofStack does not intentionally request or collect the following for ordinary use of the Services:

• Social Security numbers;
• government identification numbers;
• medical records;
• health diagnoses;
• biometric templates;
• precise geolocation for advertising purposes;
• information about race or ethnicity;
• religious beliefs;
• political affiliation;
• sexual orientation;
• personal financial account passwords.

Do not intentionally submit highly sensitive personal information to ProofStack unless it is genuinely necessary for functionality you knowingly choose to use.

Because ProofStack is a development environment, information appearing in source code, terminal output, repositories, or files may incidentally contain information of this kind.

You are responsible for determining whether such information should be exposed to connected agents, providers, remote devices, or other tools.

22. HOW WE USE INFORMATION

We may process information for purposes including:

• providing the Services;
• maintaining user accounts;
• authenticating users;
• processing subscriptions;
• providing remote functionality;
• pairing devices;
• transmitting authorized development events;
• providing customer support;
• responding to privacy requests;
• preventing fraud;
• maintaining security;
• detecting abuse;
• diagnosing technical problems;
• improving reliability;
• maintaining subscriptions;
• complying with legal obligations;
• enforcing ProofStack agreements;
• protecting ProofStack, its users, and others.

We will not intentionally process personal information for a materially unrelated purpose without appropriate notice or consent where required.

23. WE DO NOT SELL PERSONAL INFORMATION

ProofStack does not sell personal information for money.

ProofStack also does not intend to share personal information for cross-context behavioral advertising or similar targeted advertising.

If these practices materially change in the future, this Privacy Policy will be updated and any choices required by applicable law will be provided before those new practices begin.

24. NO TARGETED ADVERTISING

ProofStack does not currently use your:

• source code;
• repositories;
• prompts;
• terminal activity;
• agent activity;
• account information;

to deliver targeted advertising.

ProofStack does not currently operate an advertising network.

25. SERVICE PROVIDERS

ProofStack may use independent service providers to perform necessary functions.

Categories of providers may include:

• authentication providers;
• database and backend providers;
• cloud infrastructure providers;
• relay or networking providers;
• payment processors;
• email-delivery providers;
• analytics providers;
• hosting providers;
• security providers;
• customer-support providers.

These providers may process information only to the extent reasonably necessary for the services they provide, subject to their contractual and legal obligations.

ProofStack attempts to select service providers appropriate to the information and functionality involved.

26. THIRD-PARTY AI AND DEVELOPMENT SERVICES

Third-party AI services, coding agents, Git providers, hosting services, cloud providers, and other developer tools that you independently connect are not necessarily ProofStack service providers.

They may act independently under agreements between you and them.

ProofStack is not responsible for independent third parties' privacy practices.

You should review the privacy policy of each third-party service before providing it with sensitive information.

27. LEGAL DISCLOSURES

ProofStack may disclose information where reasonably believed necessary to:

• comply with applicable law;
• comply with valid legal process;
• respond to a lawful court order;
• respond to a subpoena or governmental request where legally required;
• investigate fraud;
• prevent abuse;
• protect the security of ProofStack;
• protect users;
• protect the rights or safety of another person;
• establish, exercise, or defend legal claims.

ProofStack may challenge or limit requests where appropriate and legally permitted.

28. BUSINESS TRANSFERS

ProofStack may later become owned or operated through an LLC, corporation, partnership, or other legal entity.

ProofStack may also be involved in:

• a sale;
• acquisition;
• merger;
• financing;
• restructuring;
• transfer of assets;
• transfer to a successor operator.

Information associated with ProofStack may be transferred as part of such a transaction or organizational change, subject to applicable law.

Any successor receiving personal information will be subject to applicable privacy obligations concerning that information.

29. DATA RETENTION

ProofStack attempts to retain information only for as long as reasonably necessary for the purposes described in this Privacy Policy.

Retention may depend upon the type of information.

For example:

Account information may be retained while your account exists and for a reasonable period afterward where necessary for security, fraud prevention, dispute resolution, or legal obligations.

Subscription and transaction records may be retained as necessary for accounting, tax, payment, fraud-prevention, and legal requirements.

Support communications may be retained as necessary to respond to requests and maintain support history.

Remote-session information may be temporarily processed or buffered as necessary to operate remote functionality.

Locally stored development information remains on your device according to application functionality and your actions.

Analytics information is retained according to ProofStack's applicable analytics configuration and the analytics provider's policies.

Information may be anonymized or aggregated instead of deleted where it can no longer reasonably identify you.

Backup systems may retain information for a limited period after deletion before being overwritten.

30. ACCOUNT DELETION

You may request deletion of personal information associated with your ProofStack account by contacting:

Deleting an account may result in loss of access to:

• paid Services;
• account settings;
• remote-device connections;
• subscription-related functionality;
• other account-dependent features.

Deletion does not necessarily require immediate deletion of information that must be retained for:

• legal obligations;
• tax records;
• payment records;
• fraud prevention;
• security;
• dispute resolution;
• exercise or defense of legal claims.

Where legally permitted, such information will be retained only for the applicable purpose.

31. PRIVACY RIGHTS

Depending upon where you live and which privacy laws apply to ProofStack, you may have rights concerning your personal information.

Those rights may include the right to:

• confirm whether personal information is being processed;
• access personal information;
• correct inaccurate information;
• request deletion;
• obtain a portable copy of certain information;
• withdraw consent where processing depends upon consent;
• opt out of certain targeted advertising;
• opt out of certain sales of personal information;
• opt out of certain qualifying profiling activities;
• appeal certain privacy-request decisions;
• exercise privacy rights without unlawful discrimination.

ProofStack does not currently sell personal information or use personal information for targeted advertising as described above.

32. TEXAS PRIVACY RIGHTS

Where the Texas Data Privacy and Security Act applies, eligible Texas consumers may have rights including:

• confirming whether their personal data is being processed;
• accessing their personal data;
• correcting inaccuracies;
• deleting qualifying personal data;
• obtaining qualifying personal data in a portable format;
• opting out of certain sales, targeted advertising, or qualifying profiling.

ProofStack will respond in accordance with applicable law.

33. PRIVACY REQUEST VERIFICATION

We may need to verify your identity before providing, correcting, or deleting personal information.

Verification protects users from unauthorized requests.

Depending upon the request, verification may involve confirming:

• account access;
• email ownership;
• authentication information;
• transaction information;
• other information reasonably necessary to verify the request.

We will not intentionally request substantially more information than reasonably necessary for verification.

34. AUTHORIZED AGENTS

Where applicable privacy law permits an authorized agent to make a request on your behalf, ProofStack may require reasonable proof that the agent has authority to act for you.

ProofStack may also require you to verify your identity directly where permitted by law.

35. SECURITY

ProofStack uses administrative, technical, and organizational safeguards intended to protect personal information appropriate to the nature of the information and the Services.

Security measures may include technologies and practices related to:

• authentication;
• encrypted network communications;
• authorization controls;
• access restrictions;
• account security;
• device pairing;
• session controls;
• infrastructure security;
• monitoring for abuse.

However:

NO INTERNET SERVICE, COMPUTER SYSTEM, SOFTWARE APPLICATION, STORAGE SYSTEM, OR TRANSMISSION METHOD CAN BE GUARANTEED TO BE 100% SECURE.

ProofStack cannot guarantee that unauthorized parties will never defeat security measures.

You are responsible for maintaining the security of your own:

• computer;
• ProofStack account;
• email account;
• passwords;
• provider accounts;
• API keys;
• SSH keys;
• credentials;
• connected devices.

36. SECURITY INCIDENTS

If ProofStack becomes aware of a security incident affecting personal information, ProofStack will investigate and take actions considered appropriate under the circumstances.

Where applicable law requires notification, ProofStack will provide legally required notices.

37. CHILDREN

ProofStack is not intended for children under 18 years of age.

ProofStack does not knowingly seek to collect personal information from children for ordinary use of the Services.

If you believe a child has provided personal information to ProofStack in circumstances where it should not have been collected, contact:

38. INTERNATIONAL USERS

ProofStack is operated from the United States.

If you access ProofStack from another country, information processed through ProofStack infrastructure or its service providers may be transferred to or processed in the United States or other countries where service providers operate.

Those countries may have privacy laws different from the laws of your country.

Where applicable law requires particular safeguards for international transfers, ProofStack will take measures required by applicable law.

39. LEGAL BASES WHERE REQUIRED

Where applicable law requires ProofStack to identify a legal basis for processing personal information, processing may be based upon:

Performance of a contract — where processing is necessary to provide ProofStack or a subscription you requested.

Legitimate interests — where reasonably necessary to operate, secure, improve, and protect the Services and those interests are not overridden by applicable privacy rights.

Consent — where you voluntarily choose optional processing such as certain analytics.

Legal obligations — where information must be processed or retained to comply with applicable law.

Consent may be withdrawn where applicable, although withdrawal does not affect processing already lawfully performed.

40. DO NOT TRACK AND PRIVACY SIGNALS

Browsers and devices may provide privacy signals such as Do Not Track or recognized opt-out preference signals.

ProofStack will respond to legally required privacy signals where applicable to processing covered by those requirements.

Because ProofStack does not currently sell personal information or use it for cross-context behavioral advertising, certain advertising opt-out signals may not require any additional change to ProofStack's current practices.

41. AGGREGATED AND DE-IDENTIFIED INFORMATION

ProofStack may create aggregated or de-identified information that cannot reasonably be associated with an identifiable individual.

Such information may be used for purposes including:

• improving ProofStack;
• understanding feature performance;
• reliability analysis;
• security;
• product development.

Where information is maintained as de-identified information, ProofStack will not intentionally attempt to re-identify it except where permitted by law for purposes such as testing whether de-identification remains effective.

42. YOUR RESPONSIBILITIES WHEN USING PROOFSTACK FOR OTHER PEOPLE'S DATA

If your repositories, files, prompts, terminal sessions, or development environments contain personal information belonging to:

• customers;
• employees;
• clients;
• users;
• contractors;
• other individuals;

you are responsible for determining whether you have permission and a lawful basis to process that information through the tools and providers you choose.

ProofStack's Privacy Policy does not replace your own privacy, confidentiality, employment, contractual, or legal obligations.

43. LINKS TO THIRD-PARTY SERVICES

ProofStack may contain links to third-party websites, services, documentation, repositories, providers, or platforms.

A link does not mean ProofStack controls that service.

Third-party privacy practices are governed by the third party's own policies.

44. CHANGES TO THIS PRIVACY POLICY

ProofStack may update this Privacy Policy as the Services change.

When changes are made, the Effective Date at the top of this Privacy Policy will be updated.

If a change materially affects how personal information is collected, used, or disclosed, ProofStack will provide additional notice where required by applicable law.

Where legally required, ProofStack may request consent before beginning materially different processing.

We will not intentionally disguise material privacy changes.

46. SUMMARY OF OUR CURRENT PRIVACY COMMITMENTS

In plain language:

We do not sell your personal information.

We do not sell your source code.

We do not use your source code, repositories, prompts, or terminal activity for targeted advertising.

We do not use your User Content to train ProofStack-owned general-purpose AI models.

Your independent AI providers may receive information you intentionally send through their agents and are governed by their own policies.

Local development information can remain local when you use local-only features.
